Update on the Teacher Porn Case

I posted about this awhile ago but I'll do a quick recapp for anyone who didn't see it.  Julie Amero was convicted after a computer she had been using began to wildly display sexually based pop ups, the woman was NOT surfing for porn and only used the computer for reading email and for taking attendance. The woman, from what I have read, was not tech savvy and did not know how to stop the pop ups (I can tell you it can be hard to turn them off).  This woman was arrested and convicted for this and faced 40 years in prison! A judge later overturned her conviction, but prosecuters filed charges again. The teacher pleaded guilty to a misdemeanor and lost her teaching certification. I didn't see it in the article but I wouldn't be surprised if she would have had to registered as a sex offender.

The whole thing is a disgrace and a mess! The charges filed were for "risk of injury to a minor", huh? Seeing naked people on a TV screen injures teenagers? Keep in mind this was a middle school, kids see each other naked in the showers by now and have no doubt seen thier parents naked, and have the net at home.

I also take issue with a 40 year sentence for something so trivial. Christ some pervert in our town just got 7 years for ACTUALLY sexually violating a 12 year old. The sentence just doesn't fit the crime here, 40 years is too excessive. The woman didn't open the porn this was done by malicious programming on what I believe was a community computer, which means anyone could have infected the system. Where were the firewalls, anti-virus, and other security software? The school should have made sure all that was in place so something like this would never have happened. It seems to me the school needed to place the blame on someone else so they didn't have own up to thier screw up.

Let us be honest here, these kids weren't harmed in anyway. They saw some penis and vagina in a classroom, something they've likely already seen on the computer at home. I also wonder how many of the kids in this class are already sexually active, most of them probably have done the deed. The notion that these kids were harmed by a mere glimpse of some porn is outrageous! The prosecuter who bought the case before a judge should be ran out of office, I would be the first to lead that rally!

We've got people being raped, molested, murdered, and ripped off by REAL criminals and THIS is what we focus on? No wonder why we have so much crime.

It was about some 'new' drug that is being recalled. That part I understand, but the WORDING in the end said, and I am NOT kidding, 'If YOU or someone you know has DIED, give us a call as you MAY be entitled to money.'

So, am I to understand that IF I DIED from said drug, I could be PAID!?!?!?! And How would I get said compensation? Would the money be BURIED with me?Furious Wasn't ANYONE PROOFREADING this copy?

Stella Awards. . .

Scott Anthony Gomez Jr, 22, was an inmate at the Pueblo County, Colo., jail. He escaped from his cell, made it to the roof …and fell 40 feet while trying to climb down the outside wall. It was his second escape, but this one cost the county $64,000 to treat the injuries Gomez caused himself. When the county asked him to pay for the medical treatment, Gomez replied by suing in federal court in Denver. The basis? "Defendants … did next to nothing to ensure that the jail was secure and the plaintiff could not escape," the suit says, and he says he had warned jailers that "there were many ways to get out of the facility." That's right: it was the jail's fault he escaped, because it was too easy. And therefore any injuries he sustained should be paid for by the county. Surely a bit of "pain and suffering" would be welcome too — the suit doesn't specified the monetary damages he wants. Gomez's attorney had no comment, but Pueblo County Sheriff Kirk Taylor did: he says the suit "doesn't pass the straight-face test." The county has spent $1.2 million for security improvements, and there have been no more escapes — by Gomez or anyone else. STATUS: Apparently still pending. JUMP SUITS ARE ALL THE FASHION

Jeb Corliss, 31, was grabbed just as he tried to jump off New York's Empire State Building in 2006. He wasn't suicidal: he had a parachute. In addition to being charged with reckless endangerment with "depraved indifference to life" (which made it a felony), the Empire State Building Company sued him for $12 million for endangering bystanders and, I would assume, for exposing them to liability (the Company said it wanted to discourage others from trying a similar stunt). They also accused Corliss of having financial motivations. That's not Stella Awards-worthy, though; this is: in January Corliss counter-sued the Empire State Building Company in New York Supreme Court in Manhattan, charging that restraining him from jumping was "unlawful imprisonment," which caused him "emotional distress" as well as "adrenal fatigue" ("very similar to battle fatigue syndrome," he said), which led to loss of income. For all of that, he demands $30 million. Meanwhile, his felony charge was thrown out by a judge, but an appeals court reinstated the reckless endangerment charge as a misdemeanor, ruling the "depraved indifference to life" bit was overdone, but certainly jumping off a building could endanger others. "No one was in any danger of being injured except me," Corliss complains. STATUS: Apparently still pending.

SJS! ANOTHER something for the lawyers to sue about!?!?!?!

I am truly not saying people that are not affected by this horrid disease (which disease ISN'T 'horrid'Undecided), but to 'push' people to going to a lawyer to 'have your case examined' which is, I believe, lawyerese for, 'If WE can't make big bucks from your case, you don't HAVE a case!'Furious 

BTW, this is what SJS is - Stevens-Johnson Syndrome is a potentially deadly skin disease that usually results from a drug reaction. Another form of the disease is called Toxic Epidermal Necrolysis, and again this usually results from a drug-related reaction. Drugs that have been linked to Stevens-Johnson Syndrome include NSAIDS (non-steroid anti-inflammatory drugs), Allopurinol, Phenytoin, Carbamazepine, barbiturates, anticonvulsants, and sulfa antibiotics. In some cases, the condition is caused by a bacterial infection, and in many cases there is no known cause for the onset of Stevens-Johnson Syndrome or Toxic Epidermal Necrolysis.

I just couldn’t help it . . .

        It's time again for the annual 'Stella Awards'!

        F or those unfamiliar with these awards, they are named after 81-year-old Stella Liebeck who spilled hot coffee on herself and successfully sued the McDonald's in New Mexico where she purchased the coffee.  You remember, she took the lid off the coffee and put it between her knees while she was driving. Who would ever think one could get burned doing that, right?

        That's right; these are awards for the most outlandish lawsuits and verdicts in the U.S.  You know, the kinds of cases that make you scratch your head. So keep your head scratcher handy. These are also the people that vote in this country!

        Here are the Stella's for the past year:

        7TH PLACE:

        Kathleen Robertson of Austin, Texas was awarded $80,000 by a jury of her peers after breaking her ankle tripping over a toddler who was running inside a furniture store. The store owners were understandably surprised by the verdict, considering the running toddler was her own son.

        6TH PLACE:

        Carl Truman, 19, of Los Angeles , California won $74,000 plus medical expenses when his neighbor ran over his hand with a Honda Accord. Truman apparently didn't notice there was someone at the wheel of the car when he was trying to steal his neighbor's hubcaps.

        Go ahead, grab your head scratcher.

        5TH PLACE:

        Terrence Dickson, of Bristol, Pennsylvania , was leaving a house he had just burglarized by way of the garage. Unfortunately for Dickson, the automatic garage door opener malfunctioned and he could not get the garage door to open.

        Worse, he couldn't re-enter the house because the door connecting the garage to the house locked when Dickson pulled it shut. Forced to sit for eight, count 'em, EIGHT, days on a case of Pepsi and a large bag of dry dog food, he sued the homeowner's insurance company claiming undue mental anguish. Amazingly, the jury said the insurance company must pay Dickson $500,000 for his anguish. We should all have this kind of anguish.

        4TH PLACE;

        Jerry Williams, of Little Rock , Arkansas , garnered 4th Place in the Stella's when he was awarded $14,500  plus medical expenses after being bitten on the butt by his next door neighbor's beagle - even though the beagle was on a chain in its owner's fenced yard. Williams did not get as much as he asked for because the jury believed the beagle might have been provoked at the time of the butt bite because Williams had climbed over the fence into the yard and repeatedly shot the dog with a pellet gun.

        Grrrrr … Scratch, scratch.

        3RD PLACE:

        Third place goes to Amber Carson of Lancaster , Pennsylvania because a jury ordered a Philadelphia restaurant to pay her $113,500 after she slipped on a spilled soft drink and broke her tailbone. The reason the soft drink was on the floor: Ms. Carson had thrown it at her boyfriend 30 seconds earlier during an argument.

        What ever happened to people being responsible for their own actions?

        Scratch, scratch, scratch. Hang in there; there are only two more Stellas to go…

        2ND PLACE:

        Kara Walton, of Claymont , Delaware sued the owner of a night club in a nearby city because she fell from the bathroom window to the floor, knocking out her two front teeth. Even though Ms. Walton was trying to sneak through the ladies room window to avoid paying the $3.50 cover charge, the jury said the night club had to pay her $12,000….oh, yeah, plus dental expenses. Go figure.

        1ST PLACE : (May I have a fanfare played on 50 kazoos please)

        This year's runaway First Place Stella Award winner was Mrs. Merv Grazinski, of Oklahoma City , Oklahoma , who purchased a new 32-foot Winnebago motor home. On her first trip home from an OU football game, having driven onto the freeway, she set the cruise control at 70 mph and calmly left the driver's seat to go to the back of the Winnebago to make herself a sandwich.. Not surprisingly, the motor  home left the freeway, crashed and overturned. Also not surprisingly,

        Mrs.. Grazinski sued Winnebago for not putting in the owner's manual that she couldn't actually leave the driver's seat while the cruise control was set. The Oklahoma jury awarded her, are you sitting down, $1,750,000 PLUS a new motor home. Winnebago actually changed their manuals as a result of this suit, just in case Mrs.. Grazinski has any relatives who might also buy a motor home.

        Are we, as a society, getting more stupid…or what? Blush

Elderly Briton leaves fortune to Chinese restaurant owner

LONDON (AFP) - The family of a wealthy British pensioner who left her entire fortune to the owners of a Chinese restaurant failed Friday in a legal bid to have her will declared invalid.

Nephews and nieces of Golda "Goldie" Bechal claimed that she was of unsound mind when she made the will leaving 10 million pounds (13.9 million euros, 20 million dollars) to her Kim Sing Man and his wife Bee Lian Man.

But a judge at London's High Court ruled that the testament, made in 1994, remained valid when Bechal died in 2004, aged 88, leaving a portfolio of commercial properties to her long-standing "best friends".

FEAR!!! And the marketing of FEAR!!!!!

Oh sure, y'all are thinking, 'Great Walter, ANOTHER political bashing'! But no, NOT this time, well, mostly not this time.

Politicians already get their power by keeping us in fear, this is a known fact, so why should I bring this up? No, I am talking about the fear that lawyers, doctors, pharmacy (chemical AND organic), and every marketing agency known to man! Why must we be SCARED into buying things? Remember when sex sells? Why not go back to THAT! Of course, it still does, but now (and then too) it is combined with FEAR! 'IF you want to have that date, you better wear AXE or be alone FOREVER! If you don't buy our hair product, the women won't be attracted to you and you'l be alone FOREVER! If you take this drug/eat this food, the chemicals in it WILL KILL YOU! If you take this organic supplement, it contains NATURAL things THAT WILL KILL YOU! If you have been exposed to heavy farting, you may be able to get the money YOU deserve because farting contains methane gas and it could KILL YOU!

Here's an idea, why don't we take up a class action civil suit AGAINST fear being mis-used the way it is (by EVERYONE, including the politicians)? It doesn't even matter if we lose; we would get the word out because if we do not, IT COULD KILL US!!!!

Hernia Mesh Patch Recall!

Was a Mesh Hernia Patch used in your Hernia surgery?

The U.S. Food and Drug Administration and Devol, Inc., a subsidiary of C.R. Bard initiated a recall on December 5th 2005 for its Bard Composix Kugel Mesh Large Oval and Large Circle Patch which were designed to treat ventricle hernias.

The patch is inserted through a small incision and is placed behind the hernia. A "memory recoil ring" is used to keep the patch closed until after it has been inserted in the body.

The purpose of the patch is to prevent the hernia from pushing through weakened tissue walls, specifically in cases when stomach muscles are too weak for surgery to repair the hernia. However, the "memory recoil ring" can break under the stress of placement in the body, resulting in bowel perforations and chronic intestinal fistulae.

Some of them are, but not limited to;
• Tenderness at the implant area
• Unexplained pain
• Redness at the implanted area
• Fever
• Any unusual symptoms

If you or a loved one have experienced problems with the implanted Bard Composix Kugel Mesh Hernia Patch, which may consist of bowel perforations and chronic intestinal fistulae, please contact an attorney.

Apparently ALL product containing Quinine (like Tonic Water) MIGHT cause horrific side effects! And, IF you take them for leg cramps, you MIGHT be able to collect MONEY!!!!

WTF?!?!?! Don't lawyers have ENOUGH to do than MAKE UP lawsuits??? When can I bring a civil suit AGAINST lawyers for FRIVOLOUS lawsuits??? How many YEARS hav we been DRINKING tonic water? How long since any of YOU have been ILL from the tonic water (and NOT because you mixed it with gin or something, that doesn't count!!)?

RIAA Lawsuit

What do you make of this whole mess?  I think the RIAA is outta there freakin minds for pulling stunts like this!  I don't get me wrong, I am NOT adovcating theft, but this is way to extreme. Don't you agree? The jury awarded $222,000 in damages, which for the 20 some songs she had, equals over $9000 per song! How can those buffons order her to pay that much for songs that cost $1 per song on I-Tunes?

The RIAA is blaming file sharing on the decline in music sales, which probably has had a small effect on sales. Long before Napster, Kazaa, and other P2P networks came to light, people were copying records, cd's or even taping tracks off the radio. Music sharing has been around for ages yet the industry had kept growing, whats changed all of the sudden? Simple question with a simple answer: you're not putting out very good music. We used to get Led Zepplin, Pink Floyd, The Beatles, and Aretha Franklin all we get now are Ashlee Simpson and the Spice Girls.  HEY RIAA? YOU WANT MORE OF MY MONEY PUT OUT SOME MUSIC I WANNA PAY FOR!

It just seems to me that sueing a group of people who may not be happy with the content you produce just is a bad idea. Quit looking for young women with a nice face and minimal musical talent, instead sign people with musical talent irregardless of looks. The music buying public wants to hear someone who can sing a song without studio intervention or lip syncing when live.  The best artists in the business aren't always the most attractive, look at Bob Dylan, Lyle Lovett, Beck, Moby, Cass Elliot, and Freddie Mercury these are all examples of people who managed to make huge impacts in the business despite thier looks.

In closing, drop this silly decision or at least be fair by charging this woman a more reasonable decision. No music, no matter how good it is, is worth nine grand!

A very successful lawyer parked his brand new Porsche Carrera GT in front of the office, ready to show it off to his colleagues. As he got out, a truck came along too close to the curb and completely tore off the driver’s door.

But, before the cop had a chance to ask any questions, the lawyer started screaming hysterically about how his Porsche, which he had just picked up the day before, was now completely ruined an d would never be the same, no matter how hard the body shop tries to make it new again.
After the lawyer finally wound down from his rant, the cop shook his head In disgust and disbelief. “I can’t believe how materialistic you lawyers are,” He said. “You are so focused on your possessions that you neglect the most Important things in life.”
“How can you say such a thing?” asked the lawyer.
The cop replied, “Don’t you even realize that your left arm is missing?
It got ripped off when the truck hit you!!!”
“OH, MY GOD!” screamed the lawyer.

Update

Ok, so I went to the DA’s office and met with the guy from there that wants to indite (sp) my ex. He asks me what I saw, and never once questions the difference of what I tell him vs. what I told the cops. Was super nice to me the entire time too. Anywho, my ex is going to be charged, as I was told by his lawyers detective, and I will have to go back during the trial to say it all over again. Although I was told by the cop there that in his 8 years of working he went to 2 trials that really went to a trial after being approved by the Grand Jury to charge someone.

It was amusing in one part though…….. As I was talking to the DA before the hearing I said something along the lines of “I had been calling the cops, DEA, FBI, legislatures, etc for four months and they still did nothing - how scary is that” and the other witness said “If the stupid cops would have done something this **** would have never happened”….. all while a cop was sitting in the room. It’s good to know Karma had our side then.

Oh, and Karma having our side when the scumbag drug/hooker dealer that pulled the gun died in an accident while running from the cops. Go Karma, Go.

Stupid Cops (don’t get offended slappy)

So ya’ll know the nonsense I was dealing with at the old house - boyfriend shoots at a gun-yielding crack dealer and he gets in trouble. Well today I got my subpoena. Gotta go to court tomorrow and tell them what I saw. I call his lawyer because it says I have to be there early to talk to the Assistant DA - sounds fishy to me. His lawyer calls me back and says I don’t *have* to say anything to the Asst. DA if I don’t want to, but that I must speak the truth while on stand. So I ask him “What I told the cops, or what I really saw”… *enter the lawyers pause* “you saw something?”.     Yes dip****, I told you I lied to the cops because after 4 months of phone calls they wouldn’t get the crack dealer out, WTF makes you think I told them the truth in an interview when I wasn’t sworn in.

Now I get to have coffee with HIS detective to tell her the facts of what I saw. Things are getting REAL interesting… The DA is NOT going to be happy tomorrow!!! I just don’t get how they can still be pressing charges. He was charged with 1 first deg. assault, and 3 third degrees. The first degree has moved out of the state, two of the third degrees have met with HIS lawyer and given up their rights to be a “victim” and the third died in a car accident while trying to outrun the cops (the guy that pulled the gun out). Makes no sense to me.

I am kinda looking forward to pissing off the prosecution tomorrow though!

Obvious scam, whats scary is there are people dumb enough to fall for it! A fool and his money are soon parted!  Here’s how it’ll work: you send the request info then he’ll ask you for your account number to withdraw X-number of dollars to take you as client. You’ll never hear from him again or if you do he’ll say he lost the case and won’t refund your cash. I can’t decide who are worse the people who send stuff like this, or the brainless dolts who fall for it!
